This is a binding contract between you and The Chilly Dog. Please make sure you read it. We’ve tried to make it as clear as possible, but we welcome your feedback to hello@thechillydog.com if you have suggestions or questions.

Definitions

This website is operated by The Chilly Dog. The terms “we”, “us” and “our” refer to thechillydog.com. The terms “you” and “your” refer to you, the user, subscriber, customer and/or member of our site. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). When we say “content” we mean the copyrightable text, photographs, graphics, patterns, projects and other material owned by The Chilly Dog.

Accepting these Terms

Please read these terms before using our site. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.

If we make changes to these terms, we will let you know either through the site or via email. If you do not agree to the terms, you may close your customer account or cancel your site membership. Your continued use after any change to the site constitutes your acceptance of those changes.

Permitted Users

The Chilly Dog is designed for the use of adults and young people over age 13. When you use the site, you represent that you are legally entitled to do so and are abiding by these terms.

If we learn we have collected personal information from a person under age 13, the information will be deleted as soon as possible. If you believe we might have information from a person under age 13, please contact us at hello@thechillydog.com.

Copyright and Intellectual Property

We own our stuff and you own yours.

All graphics, patterns, videos and content of this site are copyrighted by us, and are protected by US and international laws. If you are writing about something you've seen on our site you may use one image with attribution and a link back to the original source on our site.

Our content is for individual, non-commercial use only. To request additional use permissions please contact us at hello@thechillydog.com.

Disclosure

Some of the materials and products shown on this site are provided by a select group of collaborative partners. Our partners are acknowledged in posts for which they provided any yarn, needle, notion or other product support.

Our site does not use paid affiliate links. We do not receive compensation if you make purchases from other sites.

Site Rules

The Chilly Dog is designed to provide information that will help knitters improve their skills. Like knitting around the table at a yarn shop, we have a few house rules you must adhere to when using this site or our services. You agree not to do any of the following:

  • Threaten us or other users
  • Use hateful, abusive, harassing or libelous language towards us or other users
  • Use or attempt to use another person’s account
  • Attempt to obtain unauthorized access to the site
  • Disrupt the site or events hosted by The Chilly Dog
  • Impersonate another person
  • Distribute content including discount codes, members-only links, priority email address or any other public or members-only site content without authorization.

You agree that you are responsible for your actions and for any communications under your account. If it appears you have violated any of our rules, we may, in our sole discretion, remove any offending material and/or terminate your customer and/or member account.

Modifications to the Site and Price Changes

We may at any time decide to alter, amend, modify, or terminate the site, any functionality or portion of it, all in our sole discretion, and you understand that there is no guarantee that the site or any portion or functionality of it will continue to operate or be available for any particular period of time. We try to give advance notice of any material changes to the site. By using the service after revisions become effective, you agree to be bound by the revised terms If you do not agree to the revised terms, you must cancel your account.

Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of service.

Membership Billing and Payment

Site memberships are for one year and auto- renew at the rate set when the user subscribed. Users will be sent a renewal notice via their account email 15 days prior to their membership renewal. Users will also be sent a notice if their credit card will expire prior to renewal. Members are responsible for canceling their membership prior to the auto-renew date.

Membership payments are made in US dollars and are due for the entire membership period at the start of the subscription. All fees are exclusive of taxes. Memberships payments are non-refundable. Refunds will not be given if you close your member account before the end of your subscription.

Membership Cancelation and Termination

You are responsible for properly canceling your member account. Account changes can be made by signing into your account and choosing to cancel your account or by sending a cancelation request to hello@thechillydog.com.

We reserve the right to refuse service to anyone at any time for any reason. The Chilly Dog, in its sole discretion, has the right to suspend or terminate your member account and refuse any and all current or future use of the service, for any reason at any time. We have the right to delete non-active member accounts.

Disclaimer of Warranties and Limits of Liability

We strive to provide quality content and prevent interruptions to the Service. However, we do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free and our services are provided on an “as is” and “as available” basis. We do not warrant that the results that may be obtained from the use of the Service meet your requirements. You understand that you download from or otherwise obtain content or services through the site at your own discretion and risk.

Under no circumstances — including, without limitation, negligence — shall we be liable for any direct, indirect, incidental, special or consequential damages, resulting from (1) the use or the inability to use the site; (2) the cost of procurement of substitute goods and services; (3) unauthorized access to or alteration of your transmissions or data; (4) loss of profits, use, data or other intangibles, even if we have been advised of the possibility of such damages. Indemnification

You agree to indemnify, defend and hold harmless The Chilly Dog and our owners, directors, officers, partners, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the site, including but not limited to your violation of these terms. We may, at our sole discretion, assume the exclusive defense and control of any matter subject to indemnification by you. The assumption of such defense or control by us, however, shall not excuse any of your indemnity obligations.

Governing Law

Any claim arising out of your use of the Service must be brought in the courts located in Morgan County, Alabama. You hereby submit to the personal and exclusive jurisdiction of those courts.

You agree that any claim you may have arisen out of or related to these terms or your relationship with The Chilly Dog must be filed within one year after such claim arose; otherwise, your claim is permanently barred.

Deletion Requests

You have the right to request that we delete the personal information that we collected from you, subject to certain exceptions. Some communications, such as newsletters delivered via email, may be unsubscribed to via the unsubscribe link in the email.

Deletion requests may be submitted to hello@thechillydog.com. Please provide sufficient information so we can verify you are the person we collected information from and describe your request so we can understand and respond to it. We will respond to deletion requests within 45 calendar days.

If you ask, we will delete (and direct our service providers to delete) your personal information from our records unless an exception applies. We may deny your deletion request if it is necessary for us to retain the personal information to:

  • Complete a transaction, provide the services you requested, or otherwise perform the services
  • Detect security incidents or protect and prosecute against malicious, deceptive, fraudulent or illegal activity
  • Debug products to identify and repair errors that impair existing intended functionality
